Bundaberg Rum Clarion Dream System Builder Prize Draw - Deni Ute Muster Terms and Conditions
1. Information on how to enter and prizes form part of these terms and conditions. The official title of the competition is the "Dream System Builder Competition".
2. Eligibility
Prize draws are open only to legal residents of Australia. The prize draws are not open to employees of Clarion Australia Pty Ltd, Diageo Australia Ltd, their parents, subsidiaries and affiliates, and suppliers and their employees and members dealing with the prize draw or the operation of the Dream System Builder website or research, and those domiciled with such employees and members of their immediate family.
3. Promotion Period
The Promotion Period begins at EDST 9.00 am on 30th July, 2009 at closes at 11.59 p.m. EDST on 15th of September 2009 ("Promotion Period").
4. Entries
4.1 To enter the promotion, consumers must:
(a) Log on to www.dreamsystembuilder.com.au and design their own dream Clarion “Dreamsystem” ; and
(b) Tell us in 25 words or less why they deserve to win their dream Clarion “Dreamsystem”.
4.2 Entries are limited to 1 per valid email address. This is a game of skill and chance plays no part in the outcome.
5. Validity of Entries
5.1 The Promoter reserves the right to verify the validity of entries and reserves the right to disqualify any person for tampering with the entry process or for submitting an entry which is not in accordance with these Terms and Conditions.
5.2 An entrant may only register to be a Member on one occasion. Multiple registrations will be declared invalid.
5.3 The Promoter's decision is final and no correspondence will be entered into.
6. Judging of Winning Entry
All valid entries received during the Promotion Period will be judged by a panel of qualified judges appointed by the Promoter at the offices of Clarion Australia Pty Ltd (A.B.N 29 051 722 877) at 30 Corporate Dve, Moorabbin, Vic, 3189 (Clarion) at 10.00 a.m. EDST on 17th September 2009. Entries will be judged on the basis of the most creative and original answer. The Promoter’s decision is final and no correspondence will be entered into.
7. Prizes
7.1 The entry judged to be most creative and original will win their dream Clarion “Dreamsystem” as designed by them as part of entry to this promotion (including installation). This prize carries a maximum possible retail value of $4950.00 (depending on the “Dreamsystem” designed by the entrant). The Promoter accepts no responsibility for any variation in the prize value.
7.2It is a condition of accepting the prize that the winner bring their vehicle (into which their “Dreamsystem” is to be installed) to the Deniliquin Ute Muster at Conargo Road, Deniliquin at 9:00am, on 2nd of October 2009. The installation of the winners Clarion “Dreamsystem” will occur on stage at the Deniliquin Ute Muster on the 2nd and 3rd of October 2009
7.3 The prize winner will be responsible for transporting their vehicle to and from the event.
7.4 The prize is not transferable or exchangeable and cannot be taken as cash and must be taken as awarded.
7.5 The prize does not (unless expressly stated) include: (i) transportation costs to or from the Deniliquin Ute Muster or any accommodation; (ii) entry tickets to the Deniliquin Ute Muster (iii) meals or beverages; (iv) spending money; (v) insurance (such as travel or health cover); (vi) any other ancillary costs which may be incurred by the winner in relation to the prize.
8. Notification and Unclaimed Prizes
8.1 Winners will be notified by both email or phone and the names of the winners' of prizes will be published on the Dream System Builder and Bundaberg Rum websites (www.dreamsystembuilder.com.au and www.bundabergrum.com.au) no later than the 17/9/09. The winner may be required to provide Diageo Australia Ltd with proof that the winner is the authorized account holder of the email address associated with the winning entry or a family member of the authorized account holder of the winning entry. Identification considered suitable for verification is at the discretion of the Promoter. The winner must also provide evidence that the vehicle used for installation of the prize is owned by them or they provide satisfactory evidence that appropriate permission has been granted by the owner of the vehicle to the winner for this purpose.
8.2 Prizes must be claimed by 9:00am on the 16th September 2009. It is a condition of claiming of the prize that the selected winner attend the Deniliquin Ute Muster on 2 October 2009 with a vehicle for installation of the prize. If the selected winner does not claim the prize by this date and is unable confirm to the Promoter by this date that they are able attend this event on the specified date and time , they will forfeit the prize and the Promoter may select another entrant (on the basis of the same criteria and method as set out in these terms and conditions) to award the prize to.
8.3 The prize must be taken as stated. If for any reason the winner cannot take the prize in accordance with these terms and conditions, including at the place, date and time specified by the Promoter, the prize will be forfeited and will not be redeemable for cash.
8.4 If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.
9. Publicity
Winners may be asked to participate in publicity. By accepting the prize, each winner grants to Clarion Australia Pty Ltd and the Promoter the right to use his or her name, likeness, home town, biographical information and the fact that they have won a prize for any lawful purpose, without any further compensation, except where prohibited by law. As a condition of claiming the prize, winners agree to provide a photograph of themselves and may be asked to participate in a short interview with Clarion Australia Pty Ltd or the Promoter, both of which may be published on any of Clarion Australia's websites or the Promoter’s websites at the Promoter's discretion.
The Promoter may photograph, video and/or film any activity in connection with the prize. The winner acknowledges that the Promoter has the right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it sees fit without further permission from or payment to the winner.
10. Liability
10.1 The Promoter is not responsible for late, lost, misdirected, mechanically reproduced, mis delivered, incomplete, illegible, or unintelligible entries ; unavailable network connections; failed, incomplete, garbled, or delayed computer transmission; on line failures; hardware software or other technical malfunctions or disturbances; or any other communications failures or circumstances affecting, disrupting or corrupting the prize draw in any manner including without limitation, receipt of entries, entrance ability to participate in the prize draw winner notification, or winner response to notification. The Promoter is not responsible for any damage to entrant's computer occasioned by participation in the prize draw or downloading of any information necessary to participate in the prize draws. Any costs associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. Any contact details entered incorrectly on the website shall be deemed invalid.
10.2 The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for personal injury which is suffered or sustained, as a result of taking any of the prizes, except for any liability which cannot be excluded by law.
11. Privacy
The Promoter collects entrants' personal information in order to conduct the promotion. If the information requested is not provided, the entrant may not participate in the promotion. Entrants' personal information may be disclosed to State and Territory lottery departments and winners' names published as required under the relevant lottery legislation. Please refer to Diageo Australia's Privacy Statement for the Promoter's Privacy Policy. A request to access, update or correct any information should be directed to the Promoter at the addressed listed below.
12. The Promoter and event organizers expressly reserve the right to eject any winner (and/or his/her companions) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize, or if the Promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
13. The Promoter advocates the responsible service and consumption of alcohol and abides by a strict code of marketing practice for alcoholic beverages. It is a condition of this promotion that Participating Retailers comply with applicable regulations and guidelines for the responsible service and promotion of alcohol. Participating Retailers are encouraged to visit www.alcoholguidelines.gov.au for information on safe drinking, standard drinks and related issues.
